EXECUTIVE SESSION TO DISCUSS THREE PERSONNEL, ONE FINANCIAL, ONE LEGAL AND TWO CONTRACTUAL MATTERS.


    Trustee McCarthy moved to go into Executive Session to discuss three personnel, one financial, one legal and two contractual matters.

    Seconded by Trustee Catalano and adopted by a full vote in the affirmative.

    Trustee Catalano moved to end the Executive Session.

    Seconded by Trustee McCarthy and adopted by a full vote of all members present.

CORPORATION PROCEEDINGS

The meeting was called to order at 8:00 p.m. by Mayor Mang. Mayor Mang led the Pledge of Allegiance.


BOARD APPROVED AN ADDENDUM TO THE 2009 SENIOR NUTRITION AGREEMENT.


    Trustee Muscarella moved to approve an addendum to the 2009 Senior Nutrition Agreement and authorizing the Mayor to sign.  A copy of which is appended to these minutes for record purposes.

    Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.



BOARD APPROVED THE APPOINTMENT OF KEVIN WILES AS COURT CLERK.


    Trustee McCarthy moved to approve the appointment of Kevin Wiles as Court Clerk for the Village of Kenmore, effective December 21, 2009 at an annual salary of $27,865.00.

    Seconded by Trustee Catalano and adopted by a full vote in the affirmative.



BOARD APPROVED THE APPOINTMENT OF NANCY SMITH AS A PART-TIME COURT CLERK.


    Trustee Catalano moved to approve the appointment of Nancy Smith as part-time Court Clerk for the Village of Kenmore, effective December 31, 2009 at an hourly rate of $23.00 per hour.

    Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.

    Trustee Muscarella abstained.



BOARD APPROVED A ONE YEAR EXTENSION TO THE MANG PARK LEASE.

    Trustee Muscarella moved to approved a resolution granting a one year extension to the Mang Park Lease Agreement between the Village of Kenmore and the Town of Tonawanda.

    Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.



BOARD APPROVED AN INTERMUNICIPAL AGREEMENT REGARDING THE MUNICIPAL BUILDING.


    Trustee McCarthy moved to approve an Intermunicipal Agreement with the Town of Tonawanda regarding the Municipal Building.  A copy of which is appended to these minutes for record purposes.

    Seconded by Trustee Catalano and adopted by a full vote in the affirmative.



BOARD CONDUCTED A HEARING PERTAINING TO AN UNLICENSED VEHICLE.

    The Clerk advised that this was the time and the place to conduct a hearing pertaining to an unlicensed vehicle located at 244 Argonne Drive.

    Trustee Catalano moved to open the hearing.

    Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

    Mayor Mang asked three times if the owner was present and received no response.

    Building Inspector Michael Berns verified that there had been two violation notices sent: one October 13, 2009 and one sent on November 13, 2009.  Mr. Berns stated that neither of the two letters were returned to the Village of Kenmore.  The letters made it clear that the unlicensed vehicle must be removed or stored in a covered area.  A letter, dated December 14, 2009, advised of a hearing to take place on December 15, 2009.  Mr. Berns presented photos of the vehicle in the driveway of 244 Argonne Drive which were taken today.

    Mayor Mang asked if anyone else wished to be heard.  As no one wished to be heard, Trustee Muscarella moved to close the hearing.

    Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.



BOARD APPROVED A RESOLUTION FINDING THE PROPERTY AT 244 ARGONNE DRIVE IN VIOLATION OF CHAPTER 14 OF THE VILLAGE OF KENMORE MUNICIPLE CODE.

    Trustee Muscarella moved to approve a resolution that the property is in violation of Chapter 14 of the Kenmore Municiple Code.  A copy of this resolution is appended to these minutes for record purposes.

    Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.

BOARD APPROVED THE LIST OF UNPAID TAXES FOR 2009-2010.


    Trustee Catalano moved to approve the list of unpaid taxes for fiscal year 2010 and authorize the Clerk Treasure to forward this list to Erie County.  A copy of which is appended to these minutes for record purposes.

    Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.



ABSTRACT OF AUDITED VOUCHERS.


    Trustee Muscarella offered the following resolution and moved its adoption:

    RESOLVED, that the Mayor be and he hereby is authorized to sign the Abstract of Audited Vouchers dated December 15, 2009, in the amount of $451,661.97; General Fund $110,315.88; Community Development Fund $224,735.32; Water Fund $898.19; Sewer Fund $115,712.58 and to direct the Treasurer to pay each of the listed claimants in the amount appearing opposite his/her name.

    Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.




INVITATION FOR PUBLIC COMMENT/QUESTIONS


    A moment of silence was observed for Richard Seger, Trustee Bestine’s father.

    As no one else wished to be heard the meeting was adjourned.  Mayor Mang wished everyone Happy Holidays.

    The next meeting of the Board of Trustees will be January 5, 2010 at 8:00 p.m. at the Municipal Building.
