EXECUTIVE SESSION TO DISCUSS TWO FINANCIAL MATTERS.


    Trustee Muscarella moved to go into Executive Session to discuss one personnel, one financial and two legal matters.

    Seconded by Trustee Catalano and adopted by a full vote in the affirmative.

    Trustee Muscarella moved to end the Executive Session.

    Seconded by Trustee Catalano and adopted by a full vote of all members present.

The meeting was called to order at 8:00 p.m. by Mayor Mang. Mayor Mang led the Pledge of Allegiance.


BOARD APPROVED THE APPOINTMENT OF PATRICK D. PHILLIPS AS A PART-TIME BUILDING INSPECTOR.

    Trustee McCarthy moved to approve the appointment of Patrick D. Phillips of 336 Wardman Road as a part-time Code Enforcement Officer for the Village of Kenmore, effective October 7, 2009, at a rate of pay of $19.00 per hour.

    Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.



BOARD APPROVED VARIOUS FUND TRANSFERS.


    Trustee Bestine moved approve fund transfers to and from various accounts.

    Seconded by Trustee Catalano and adopted by a full vote in the affirmative.



BOARD CONDUCTED A HEARING PERTAINING TO LOCAL LAW #4 OF 2009, ENTITLED “AMEND CHAPTER 16, PEDDLERS, SOLICITORS, TRANSIENT, MERCHANTS, ETC.”

The Clerk advised that this was the time and place to conduct a hearing pertaining to Local Law #4 of 2009, entitled “Amend Chapter 16, Peddlers, Solicitors, Transient, Merchants, Etc.”

    Trustee Muscarella moved to open a hearing pertaining to Local Law #4 of 2009.

    Seconded by Trustee McCarthy  and adopted by a full vote in the affirmative.

    Clerk/Treasurer Kathleen P. Johnson read the Legal Notice, which summarized the Local Law.

    The Mayor asked if anyone had questions or comments.  There were none.

    Trustee Catalano moved to close the hearing.

    Seconded by Trustee Bestine and adopted by a full vote in the affirmative.

BOARD APPROVED THE INVESTMENT REPORT FOR THE VILLAGE OF KENMORE.


    Trustee Bestine moved to approve the Investment Report for the Village of Kenmore for the period of June 1, 2009 – September 30, 2009.

    Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.


BOARD APPROVED AND GRANTED PERMISSION TO CAPTAIN WILLIAM PHILLIPS TO ATTEND TWO TRAINING COURSES.


    Trustee Muscarella moved to approve and grant permission to Captain William Phillips to attend two courses entitled “ICS-300”, October 5-7, 2009 and “ICS-400”, October 14-15, 2009, in Cheektowaga, with Expenses.

    Seconded by Trustee Catalano and adopted by a full vote in the affirmative.



BOARD APPROVED AND GRANTED PERMISSION TO POLICE OFFICER DEAN RULE TO ATTEND A COURSE.


    Trustee McCarthy moved to approve and grant permission to Police Officer Dean Rule to attend a course entitled “Taser Instructor Course”, October 27-28, 2009, at the Academy, with Expenses.

    Seconded by Trustee Catalano and adopted by a full vote in the affirmative.



BOARD APPROVED AND GRANTED PERMISSION TO POLICE OFFICER DAVID LEWANDOWSKI TO ATTEND A SEMINAR.


    Trustee Muscarella moved to approve and grant permission to Police Officer David Lewandowski to attend a seminar entitled “Load Securement Training”, October 13, 2009, in Amherst, with Expenses.

    Seconded by Trustee Bestine and adopted by a full vote in the affirmative.



BOARD APPROVED BOARD APPROVED AND GRANTED PERMISSION TO THE CALVARY FULL GOSPEL CHURCH TO HOLD A FESTIVAL.


    Trustee Catalano moved to approve the Calvary Full Gospel Church to put up barricades between Grammercy  Avenue and West Girard Boulevard to hold a “Light The Night Festival” on Saturday October 31, 2009 at the request of Pastor Daniel Zgrablish.

    Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.



BOARD APPROVED AN AGREEMENT FOR THE COMMUNITY BLOCK GRANT RECOVERY ACT.


    Trustee McCarthy moved to approve an agreement for the Community Block Grant Recovery Act.

    Seconded by Trustee Bestine and adopted by a full vote in the affirmative.



BOARD APPROVED AND GRANTED PERMISSION TO THE RESIDENTS OF ARGONNE DRIVE TO HOLD A BLOCK PARTY.


    Trustee Bestine moved to approve and grant permission to the residents of Argonne Drive between Colvin Boulevard and Hiler Avenue, to hold their Halloween Block Party on Saturday, October 31, 2009 at the request of Sabina Mooney.

    Seconded by Trustee Catalano and adopted by a full vote in the affirmative.



BOARD APPROVED AND AWARDED A BID FOR PLOW EQUIPMENT AND A DUMP BODY FOR THE DEPARTMENT OF PUBLIC WORKS.


    Trustee Muscarella moved to approve and award of bid to Viking Cives of Western New York, 2917 Judge Road, Oakfield, New York 14125, for plow equipment and a dump body for the Department of Public Works as the lowest qualified bidder at $51,652.00.

    Seconded by Trustee Bestine and adopted by a full vote in the affirmative.



ABSTRACT OF AUDITED VOUCHERS.

    Trustee Bestine offered the following resolution and moved its adoption:

    RESOLVED, that the Mayor be and he hereby is authorized to sign the Abstract of Audited Vouchers dated October 6, 2009, in the amount of $746,498.49; General Fund $413,397.89; Community Development $218,002.32; Water Fund $107835.14; Sewer Fund $7,263.14 and to direct the Treasurer to pay each of the listed claimants in the amount appearing opposite his/her name.

    Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.




INVITATION FOR PUBLIC COMMENT/QUESTIONS


    Mayor Mang asked if any one wished to be heard.

    Carol Anne Gleason of 306 Argonne commented on the frequency of accidents at the intersection of Colvin Boulevard and Argonne Drive.  Ms. Gleason feels that something needs to be done before there is a fatality.  Ms. Gleason suggested coordinating signals.

    Mayor Mang referred her to the Kenmore Police Department.  Mayor Mang stated that Colvin is a County road, therefore it is the County’s responsibility for the timing of the lights.

    Mayor Mang announced that the Village of Kenmore had received a national award from the American Planning Association as “One of the Top 10 Outstanding Neighborhoods in the United States for 2009”.  The Mayor read the press release and announced that there would be a celebration on October 31, 2009 at 11:00 AM.

    As no one else wished to be heard the meeting was adjourned.

    The next meeting of the Board of Trustees will be October 20, 2009 at 8:00 p.m. at the Municipal Building.
