EXECUTIVE SESSION TO DISCUSS.
Trustee Muscarella moved to go into Executive Session to discuss three litigation and two personnel matters.
Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.
Trustee McCarthy moved to end the Executive Session.
Seconded by Trustee Catalano and adopted by a full vote of all members present.

The meeting was called to order at 8:00 p.m. by Mayor Mang. Mayor Mang led the Pledge of Allegiance.
BOARD CONDUCTED A HEARING PERTAINING TO THE BUDGET FOR THE VILLAGE OF KENMORE FOR FISCAL YEAR 2000-2010.
The Clerk advised that this was the time and place called for in the legal notice to conduct a hearing pertaining to the budget for the Village of Kenmore for Fiscal Year 2009-2010.
Trustee Bestine moved to open the hearing.
Seconded by Trustee Muscarella and adopted by a full vote of all members present.
Mayor Mang read a prepared message, a copy of which is appended to these minutes for record purposes. No comments or questions were brought to the Board’s attention.
Trustee Bestine moved to close the hearing.
Seconded by Trustee Muscarella and adopted by a full vote of all members present.
BOARD APPROVED THE BUDGET PROPOSED FOR THE VILLAGE OF KENMORE FOR FISCAL YEAR 2009-2010 AND SETTING OF THE TAX RATE.
Trustee Catalano moved to approve the proposed budget for the Village of Kenmore for Fiscal Year 2008-2009 and setting of the tax rate, a copy of which is appended to these minutes for record purposes.
Seconded by Trustee McCarthy and adopted by a full vote of all members present.
A Roll Call Vote was taken as follows:

BOARD AWARDED A BID FOR RECONSTRUCTION OF LINCOLN BOULEVARD.
Trustee Muscarella moved to award the bid for reconstruction of Lincoln Boulevard to Visone Construction, Inc. at the lowest qualified bid of $1,740,900.70.
Seconded by Trustee Bestine and adopted by a full vote in the affirmative.
BOARD APPROVED THE APPOINTMENT OF TWO NEW ACTIVE MEMBERS FOR THE KENMORE VOLUNTEER FIRE DEPARTMENT.
Trustee McCarthy moved to approve the appointment of Barbara M. Bauer and David V. DiSanto as new active members for the Kenmore Volunteer Fire Department.
Seconded by Trustee Catalano and adopted by a full vote in the affirmative.
BOARD APPROVED THE CANCELLATION OF A SIGN BOND.
Trustee Muscarella moved to approve the cancellation of a Sign Bond for the pole sign located at 2827-2833 Delaware Avenue in Kenmore.
Seconded by Trustee Bestine and adopted by a full vote in the affirmative.
BOARD APPROVED AND GRANTED APPROVAL FOR A CONTINUATION OF A FENCE AGREEMENT.
Trustee Catalano moved to approve the continuation of a Fence Agreement between the Village of Kenmore and Mr. and Mrs. Donald Casey, SR. of 383 Hamilton Boulevard.
Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.
BOARD APPROVED AND GRANTED PERMISSION FOR A WORKING CREW CHIEF AND THE SUPERINTENDENT OF PUBLIC WORKS TO ATTEND A SEMINAR.
Trustee McCarthy moved to approve and grant permission for Working Crew Chief Jack Johnson and Department of Public Works Superintendent John Neiss to attend the 2009 Highway School on June 1-9, 2009 in Ithaca, New York, with expenses.
Seconded by Trustee Catalano and adopted by a full vote in the affirmative.
ABSTRACT OF AUDITED VOUCHERS.
Trustee Bestine offered the following resolution and moved its adoption:
RESOLVED, that the Mayor be and he hereby is authorized to sign the Abstract of Audited Vouchers dated April 21, 2009, in the amount of $124,884.08; General Fund $54,533.25; Community Development Fund $165.00; Water Fund $39,318.17; Sewer Fund $30,867.66: and to direct the Treasurer to pay each of the listed claimants in the amount appearing opposite his/her name.
Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

Mayor Mang asked if any one wished to be heard.
As no one wished to speak the meeting was adjourned.
The next meeting of the Board of Trustees will be May 5, 2009 at 8:00 p.m. at the Municipal Building.
