EXECUTIVE SESSION TO DISCUSS ONE CONTRACTUAL, ONE PUBLIC SAFETY, ONE FINANCIAL AND ONE PERSONNEL MATTER.

 

            Trustee McCarthy moved to go into Executive Session to discuss one contractual, one public safety, one financial and one personnel matter.

            Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

 

            Trustee Muscarella moved to end the Executive Session.

The meeting was called to order at 8:00 p.m. by Mayor Mang. Mayor Mang led the Pledge of Allegiance.

 

 

BOARD APPROVED THE PUBLICATION OF A LEGAL NOTICE PERTAINING TO PAST DUE WATER AND SEWER CHARGES FOR FISCAL YEAR 2007-2008.

 

Trustee McCarthy moved to approve the publication of a Legal Notice pertaining to past-due water and sewer charges, not paid by March 1, 2008, to be added to taxes for Fiscal Year 2008-2009.

            Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

 

 

 

BOARD CONDUCTED A HEARING PERTAINING TO AN UNSAFE BUILDING LOCATED AT 46 EAST HAZELTINE AVENUE.

            The Clerk advised that this was the time and the place to conduct a hearing pertaining to an unsafe building located at 46 East Hazeltine Avenue.

            Trustee Bestine moved to open the hearing.

            Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.

Mayor Mang asked Building Inspector Douglas Randall for his report.

            Building Inspector Douglas Randall stated that the property should be boarded up and sealed to preclude entry.  It is unsafe and a fire hazard. 

            Thomas Dee, owner of 46 East Hazeltine, said he needs to get his furniture, television and toys out of the house.

            Mayor Mang said he has been given a lot of time to remove his belongings and has not acted in good faith.  Mayor Mang said the records of problems with the property go back for a couple of years and he has yet to fix anything.  The Mayor doesn’t see a need for more time.

            Mr. Randall asked Mr. Dee if he agreed that the property needs to be boarded up.

Mr. Dee said he had no objection to this action.

Mr. Dee said he doesn’t have any utilities and has no money for storage.  He is requesting a two week extension.

            Mayor Mang agreed to give Mr. Dee five days to remove his things and vacate the premises.

            Mayor Mang asked if any one else wished to be heard.  As no one wished to be heard, Trustee Bestine moved to close the hearing.

            Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

DISPOSITION

 

            Trustee McCarthy moved to approve a resolution that the property is in violation of Section 7-112 of the Kenmore Municipal Code.  A copy of the resolution is appended to these minutes for record purposes.

            Trustee Bestine moved to approve the Service Award Program list for 2007 for the Kenmore Fire Department.

BOARD APPROVED THE ANNUAL REPORT FOR THE KENMORE POLICE DEPARTMENT FOR THE CALENDAR YEAR 2007.                                                   

 

            Trustee McCarthy moved to approve the annual report for the Kenmore Police Department for the Calendar year of 2007, a copy of which is appended to these minutes for record purposes.

            Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

            Mayor Mang summarized the annual report and commented on the increased number of calls that were responded to.  He thanked the Police Department for the good work they do for the Village of Kenmore and its residents.

           

BOARD APPROVED AND GRANTED PERMISSION TO DEPARTMENT OF PUBLIC WORKS EMPLOYEES DAVID ROOT AND GLENN ARMSTRONG TO ATTEND A WATER WORKS CONFERENCE.

 

Trustee Muscarella moved to approve and grant permission to Department of Public Works Employees David Root and Glenn Armstrong to attend the annual Water Works Conference on February 6, 2008, in Batavia, with expenses.

Seconded by Trustee Bestine and adopted by a full vote in the affirmative.

 

BOARD APPROVED AND GRANTED PERMISSION TO VILLAGE TRUSTEE SALVATORE C. MUSCARELLA TO ATTEND THE NYCOM WINTER LEGISLATIVE MEETING.                                                                                     

 

            Trustee Bestine move to approve and grant permission to Village Trustee Salvatore C. Muscarella to attend a NYCOM Winter Legislative meeting on February 24-26, 2008 in Albany, New York, with expenses.

            Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.

            Trustee Muscarella moved to approve and grant permission to Police Officer Michael Wells to attend a training course entitled “Instructor Development Course” on March 2-14, 2008 at the Erie County Central Police Services Training Academy, with expenses.

Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.

             Trustee McCarthy moved to approve and grant permission to Captain William Phillips, Village Attorney Daniel Novak and Village Clerk/Treasurer Kathleen P. Johnson, Esq. to attend a seminar entitled “Civil Enforcement Strategies to Address Public Nuisance” on April 11, 2008 in Niagara Falls, New York, with expenses.

            Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

 

BOARD APPROVED A RESOLUTION IN SUPPORT OF THE COMMUNITY SCHOOL DAY OF CARING AND SHARING.                                                                  

 

            Trustee Muscarella moved to approve a Resolution in support of the Community School Day of Caring and Sharing, a copy of which is appended to these minutes for record purposes.

            Seconded by Trustee Bestine and adopted by a full vote in the affirmative.

 

BOARD APPROVED THE PUBLICATION OF A LEGAL NOTICE FOR FLOORING RENOVATIONS FOR THE KENMORE FIRE HALL.                              

 

            Trustee Bestine moved to approve the publication of a Legal Notice calling for bids for flooring renovations for the Kenmore Fire Hall.

            Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.

ABSTRACT OF AUDITED VOUCHERS.                                                             

            Trustee Bestine offered the following resolution and moved its adoption:

 

RESOLVED, that the Mayor be and he hereby is authorized to sign the Abstract of Audited Vouchers dated February 5, 2008, in the amount of $648,743.62; General Fund $492,552.10; Water Fund $93,099.65; Sewer Fund $21,569.27; Capital Fund $41,522.60 and to direct the Treasurer to pay each of the listed claimants in the amount appearing opposite his/her name.

Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

 

INVITATION FOR PUBLIC COMMENT/QUESTIONS                                    

 

Mayor Mang asked if any one wished to be heard.

 

Kevin Gaughan of Buffalo, New York delivered a presentation pertaining to town, village and city government.  He states there is no greater village in America than Kenmore.  There are twenty-five towns, sixteen villages and cities in Western New York. He says the Village of Kenmore’s public servants are wonderful, but he has a suggestion to make it better, because we are losing people and need to address that.

Mr. Gaughan believes that part of the reason that people are leaving New York is that there is too much government and too much taxation.  This stems from duplication of services between the governments.  He stated that he originally was seeking to consolidate villages, but that, after meeting with people over the course of a year, he found that people really like their village government and there was too much opposition.  He decided to re-focus his efforts to address duplication of government services and

reduce the cost of government and decided that this could be easily achieved through a reduction in the number of elected officials at every government level.  Specifically, he is wants to encourage each government to reduce that size of its governing body by 2.

Mr. Gaughan presented a 10 minute power point outlining the history of New York governments, and highlighting statistics about governments, including the number of elected officials, and the cost to the taxpayers to support their salaries.  All information is found on his website:  thecost.org. 

Twenty-seven people in Western New York were killed in the War on Terror.  Since 1970, the State has lost a quarter of a million residents.  In 1990 there was a loss of forty thousand jobs. Housing stock value is declining and Western New York is fourth in property taxes in the United States. Our per capita income is down.  Western New York has more people leaving, ages 18-34 than any other are in the United States.  Buffalo is the second poorest city in the United States. 

In the United States during the same period:

            1.  Stocks have reached record levels

            2.  Comparable city growth (ie: Portland, OR)

            3.  Local Government reform

Mr. Gaughan stated that there are 439 elected officials in Western New York which is more than the number of US Congress members.  He feels the solution is to decrease every government board by two members through attrition.

            Mrs. Frank said we only have three trustees now.

            Trustee Bestine said we have four trustees with three here and one vacancy, but there are plans to re-fill the seat.

            Mr. Cuddy of 406 Argonne commented that there are forty-five governments in Western New York and twenty-eight school systems and Kenmore should be the first to consolidate.

As no one else wished to speak the meeting was adjourned.
