EXECUTIVE SESSION TO DISCUSS THREE (3) PERSONNEL MATTERS and ONE (1) LITIGATION MATTER.

 

            Trustee Catalano moved to go into Executive Session to discuss three personnel matters and one litigation matter.

            Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

 

            Trustee Muscarella moved to end the Executive Session.

 

            Seconded by Trustee Catalano and adopted by a full vote in the affirmative.

SPECIAL BOARD MEETING

The meeting was called to order at 6:00 p.m. by Mayor Mang.

 

The Mayor noted for the record that Trustees McCarthy and Bestine were

 

participating in the meeting via teleconference, but were not voting as their presence, via

 

phone, does not satisfy the requirements of the Open’s Meeting Law. 

 

 

 

BOARD APPROVED A RESOLUTION ISSUING CHARGES AGAINST A DEPARTMENT OF PUBLIC WORKS EMPLOYEE AND ADVISING OF A HEARING

           

Trustee Muscarella moved to approve a Resolution issuing charges for incompetence/misconduct against a Department of Public Works employee under Section 75 of the Civil Service Law and Section 8-804 of the Village Law, appointing Thomas Rinaldo as a Hearing Officer and giving notice of a Hearing to take place on November 12, 2008 at 9:00 AM in the Mayor’s Office, and further notifying the employee that he is hereby suspended without pay for thirty (30) days pursuant to Section 75 of the Civil Service Law and Section 8-804 of the Village Law.  

            Seconded by Trustee Catalano and adopted by a full vote in the affirmative.

BOARD APPROVED A RESOLUTION ISSUING CHARGES AGAINST A DEPARTMENT OF PUBLIC WORKS EMPLOYEE AND ADVISING OF A HEARING

 

            Trustee Catalano moved to approve moved to approve a Resolution issuing charges for incompetence/misconduct against a Department of Public Works employee under Section 75 of the Civil Service Law and Section 8-804 of the Village Law, appointing Thomas Rinaldo as a Hearing Officer and giving notice of a Hearing to take place on November 24, 2008 at 9:00 AM in the Mayor’s Office, and further notifying the employee that he is hereby suspended without pay for thirty (30) days pursuant to Section 75 of the Civil Service Law and Section 8-804 of the Village Law.

            Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

 

BOARD APPROVED THE TERMINATION OF A DEPARTMENT OF PUBLIC WORKS EMPLOYEE AND DIRECTING THE CLERK/TREASURER TO NOTIFY THE EMPLOYEE

 

            Trustee Catalano moved for Board approval of the termination of a Department of

 

Public Works employee effective immediately pursuant to an investigation conducted by

 

the Village of Kenmore Police Department and its review of statements in evidence, and

 

further directing the Clerk/Treasurer to send notification to the employee

 

            Seconded by Trustee Muscarella and adopted by full vote in the affirmative.

                                                           

The next meeting of the Board of Trustees will be September 16 20, 2008 at 8:00 p.m. at the Municipal Building.
