EXECUTIVE SESSION TO DISCUSS TWO PERSONNEL, ONE CONTRACTUAL AND LEGAL  MATTER.

 

Trustee McCarthy moved to go into Executive Session to discuss two personnel, one contractual and one legal matter.

            Seconded by Trustee Catalano and adopted by a full vote in the affirmative.

 

            Trustee Bestine moved to end the Executive Session.

 

            Seconded by Trustee Catalano and adopted by a full vote of all members present.

The meeting was called to order at 8:00 p.m. by Mayor Mang. Mayor Mang led the Pledge of Allegiance.

 

 

BOARD APPROVED THE PUBLICATION OF A LEGAL NOTICE CALLING FOR A PUBLIC HEARING ON SEPTEMBER 2, 2008 PERTAINING TO A CABLE FRANCHISE AGREEMENT.

 

            Trustee Muscarella moved to approve the publication of a legal notice calling for a public hearing on September 2, 2008 pertaining to a Cable Franchise Agreement between the Village of Kenmore and Verizon.

            Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.

 

BOARD APPROVED THE HIRING OF PETER D. BREITNAUER AS A PROBATIONARY LABORER FOR THE DEPARTMENT OF PUBLIC WORKS.

 

            Trustee Catalano moved to approve the hiring of Peter D. Breitnauer of 35 Delwood Road as a probationary laborer for the Department of Public Works, effective August 20, 2008 at a pay rate of $12.73 per hour.

            Seconded by Trustee Bestine and adopted by a full vote in the affirmative.

BOARD APPROVED THE HIRING OF ROBERT J. MAURO AS A PROBATIONARY LABORER FOR THE DEPARTMENT OF PUBLIC WORKS.

 

            Trustee McCarthy moved to approve the hiring of Robert J. Mauro of 345 Fayette Avenue as a probationary laborer for the Department of Public Works, effective September 2, 2008 at a pay rate of $12.73 per hour.

            Seconded by Trustee Catalano and adopted by a full vote in the affirmative.

 

BOARD APPROVED THE APPOINTMENT OF JENNIFER MURPHY AS A REGULAR PART-TIME PUBLIC SAFETY DISPATCHER FOR THE KENMORE POLICE DEPARTMENT.

 

            Trustee McCarthy moved to approve the appointment of Jennifer Murphy of 23 Somerton Avenue as a regular part-time Public Safety Dispatcher for the Kenmore Police Department, effective August 20, 2008 at a pay rate of $12.37 per hour.

            Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

 

BOARD APPROVED THE APPOINTMENT OF APRIL HAYNES AS A REGULAR PART-TIME PUBLIC SAFETY DISPATCHER FOR THE KENMORE POLICE DEPARTMENT.

 

            Trustee Bestine moved to approve the appointment of April Haynes of 40 Stillwell Avenue as a regular part-time Public Safety Dispatcher for the Kenmore Police Department, effective August 20, 2008 at a pay rate of $12.37 per hour.

            Seconded by Trustee Catalano and adopted by a full vote in the affirmative.

BOARD APPROVED AND GRANTED PERMISSION TO THE ERIE COUNTY BOARD OF ELECTIONS TO USE THE KENMORE COMMUNITY CENTER AND THE MANG CULTURAL CENTER.

            Trustee Muscarella moved to approve and grant permission to the Erie County Board of Elections to use the Kenmore Community Center and the Mang Cultural Center for election purposes on September 9, 2008 and November 4, 2008.

            Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.

 

BOARD APPROVED AND GRANTED PERMISSION TO DETECTIVE ELMER ARNET TO ATTEND A SEMINAR ENTITLED “SEX OFFENDER MANAGEMENT TRAINING COURSE”.

 

            Trustee Catalano moved to approve and grant permission to Detective Elmer Arnet to attend a seminar entitled “Sex Offender Management Training Course” on September 3, 2008 in Batavia, with expenses.

            Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

 

BOARD APPROVED AND GRANTED PERMISSION TO POLICE CHIEF CARL LA CORTE AND ASSISTANT CHIEF PETER BREITNAUER TO ATTEND A TECHNOLOGY SEMINAR.

 

            Trustee McCarthy moved to approve and grant permission to Police Chief Carl La Corte and Assistant Chief Peter Breitnauer to attend a technology seminar on September 9, 2008 in Cheektowaga, with expenses.

            Seconded by Trustee Bestine and adopted by a full vote in the affirmative.

BOARD APPROVED AND GRANTED PERMISSION TO POLICE OFFICER DAVID LEWANDOWSKI TO ATTEND A SEMINAR ENTITLED “IMMIGRATION AND CUSTOMS FRAUD, TERRORISM & LOCAL HOMELAND SECURITY ISSUES”

 

            Trustee Muscarella moved to approve and grant permission to Police Officer David Lewandowski to attend a seminar entitled “Immigrations and Customs fraud, Terrorism & Local Homeland Security Issues” on September 23, 2008 at Hilbert College, with expenses.

            Seconded by Trustee Catalano and adopted by a full vote in the affirmative.

 

BOARD APPROVED AND GRANTED PERMISSION TO THE RESIDENTS OF ARGONNE DRIVE TO HOLD A BLOCK PARTY.

 

            Trustee Bestine moved to approve and grant permission to the residents of Argonne Drive, between Myron Avenue and Rowley Avenue, to hold their annual Block Party on Saturday, September 6, 2008, with a rain date of September 7, 2008 at the request of Julie Butkowski.

            Seconded by Trustee Muscarella and adopted by a full vote in the affirmative.

 

BOARD APPROVED AND GRANTED PERMISSION TO THE RESIDENTS OF ARGONNE DRIVE TO HOLD A BLOCK PARTY.

 

            Trustee Catalano moved to approve and grant permission to the residents of Argonne Drive, between Colvin Boulevard and Irving Terrace, to hold their annual Block Party on Saturday, September 6, 2008 at the request of Sabina Mooney.

            Seconded by Trustee Bestine and adopted by a full vote in the affirmative.

BOARD APPROVED AND GRANTED PERMISSION TO THE RESIDENTS OF MARQUETTE AVENUE TO HOLD A BLOCK PARTY.

 

            Trustee Muscarella moved to approve and grant permission to the residents of Marquette Avenue, between Parkwood Avenue and Warren Avenue, to hold their annual Block Party on Saturday, September 20, 2008 at the request of Ellen Little.

            Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.

 

BOARD APPROVED AND GRANTED PERMISSION TO THE RESIDENTS OF NASSAU AVENUE TO HOLD A BLOCK PARTY.

 

            Trustee Bestine moved to approve and grant permission to the residents of Nassau Avenue, between Delaware Road and Myron Avenue, to hold their annual Block Party on Saturday, September 20, 2008, with a rain date of September 27, 2208 at the request of Christina Reid.

            Seconded by Trustee Catalano and adopted by a full vote in the affirmative.

 

BOARD APPROVED A “CHILD AT PLAY” SIGN ON EAST HAZELTINE.

 

            Trustee Muscarella moved to approve a “Child at Play” sign to be installed on East Hazeltine Avenue between Rowley Avenue and Colvin Boulevard.

            Seconded by Trustee Bestine and adopted by a full vote in the affirmative.

BOARD APPROVED A SETTLEMENT AGREEMENT BETWEEN THE VILLAGE OF KENMORE AND THE DEPARTMENT OF PUBLIC WORKS BENEVOLENT ASSOCIATION.

 

            Trustee Catalano move to approve a settlement agreement between the Village of Kenmore and the Department of Public Works Benevolent Association.

            Seconded by Trustee Bestine and adopted by a full vote in the affirmative.

 

BOARD APPROVED THE REINSTATEMENT OF RYAN FITZGIBBONS AS A LABORER FOR THE DEPARTMENT OF PUBLIC WORKS.

 

            Trustee Bestine moved to approve the reinstatement of Ryan Fitzgibbons of 1358 Brookside Terrace as a laborer for the Department of Public Works, effective August 20, 2008, pursuant to a settlement agreement.

            Seconded by Trustee Catalano and adopted by a full vote in the affirmative.

 

ABSTRACT OF AUDITED VOUCHERS.

            Trustee Bestine offered the following resolution and moved its adoption:

 

RESOLVED, that the Mayor be and he hereby is authorized to sign the Abstract of Audited Vouchers dated August 19, 2008, in the amount of $235,113.17; General Fund $111,935.17; Water Fund $984.48; Sewer Fund $122,193.52 and to direct the Treasurer to pay each of the listed claimants in the amount appearing opposite his/her name.

Seconded by Trustee McCarthy and adopted by a full vote in the affirmative.

INVITATION FOR PUBLIC COMMENT/QUESTIONS

 

Mayor Mang asked if any one wished to be heard.

 

Theodore (Fred) Stinner of 991 Colvin Boulevard stated that since May there has been a problem with an odor coming into his house emanating from the street manholes.  He has called the Department of Public Works and they haven’t done anything to help him.  He said they are down wind about 20’ from a manhole.

Mayor Mang said he was aware of the problem, as it was discussed in the pre-board meeting.  He said the Department of Public Works is going to cover up the standing water tomorrow and other steps have been taken by the Village of Kenmore.  He told Mr. Stinner they are trying to alleviate the problem and can only hope for good results and asked his patience while the Village addresses the situation.

 

As no one else wished to speak, the meeting was adjourned.

 

 

The next meeting of the Board of Trustees will be September 2, 2008 at 8:00 p.m. at the Municipal Building.
